Fengxian District People’s Court Briefed on its Efforts Made in Resolving “Difficulties in Enforcement”

on december 7, 2017, fengxian district people’s court held a news conference to brief on its efforts made in resolving “difficulties in enforcement”. journalists from xinhua news agency, people’s court daily, jiefang daily, shanghai television station, eastday.com, etc., relevant leaders of legislative affairs officejustice bureau of fengxian district, people’s representativescppcc members of the district, as well as specially-invited supervisorsenforcement supervisors attended the news conference.

on the news conference, fengxian district people’s court presented the achievements made by the court in enforcement over the last two years with features. mr. han feng, vice president of fengxian district people’s court, briefed on the enforcement work of the court.

according to the brief on the news conference, fengxian district people’s court has been intensifying compulsory enforcement measures. the court, which signed the minutes on resolving “difficulties in enforcement” with public security bureauprocuratorate in the first year it took on the task of resolving “difficulties in enforcement”, again signed a upgraded version this year to use concerted efforts to punish the crime of refusing to satisfy judgementfind the missing people subject to enforcementvehicles. in the last two years, fengxian public security bureau seizeddetained 11 people. fengxian district people’s court gave sentences to 5 people committing the crime of refusing to satisfy judgement. among these cases, one case, in which a false lawsuit was filed to refuse to satisfy judgementover rmb 18 million of enforcement fund was recovered, was listed into enforcement cases of shanghai courts top 10 in 2016.

fengxian district people’s court is also giving severer punishment on defaults. over the last two years, a total of 3091 people subject to enforcement were listed into defaulters list6971 were given high consumption restraint order. the court also made bulletins to display the defaulters list in the community where these defaulters live, so as to crack down on them.

it was briefed on the news conference that fengxian district people’s court will publicize the phone numbers of enforcement judges, send the namesphone numbers of judges handling the cases to the parties involved through 12368 litigation service platform,require the enforcement judges to ensure the phone is on in working hours. with this system, the parties involved can findconsult the person in gecan contact the enforcement judge right away when finding any clue for enforcement, which greatly boosts enforcement efficiency. in the last two years, enforcement judges of the court received 971 enforcement clues on the phone provided by the parties involved, 468 of which were found true, facilitating the conclusion of 299 casesenforcing over rmb5061.

according to the brief on the news conference, based on the gathering of smallmedium-sized enterprises in fengxian district, for those enterprises subject to enforcement which cannot repay their debts but can producesell products, the court adopts the policy of “culturing fish with water” to improve the repayment ability of people subject to enforcement after all necessary enforcement measures have been taken.

by the end of october, fengxian district people’s court closed a total of 18045 cases in the last two years, with actual enforcement rate, liquidation rate of enforcement subject mattersaverage liquidation rate of enforcement subject matters being 80.97%, 80.20%81.34% respectively.
