On the afternoon of June 3, the Shanghai Intellectual Property Court (hereinafter referred to as the "SIPC") held a work conference on the diversified co-governance mechanism of environmental resources. At the conference, Chen Yajuan, Secretary of the Party Leadership Group and President of the SIPC, and Cheng Peng, Secretary of the Party Leadership Group of Shanghai Municipal Bureau of Ecology and Environment, jointly inaugurated the newly established "Contact Point for the Diversified Co-governance Mechanism of Environmental Resources"; Yu Qiuwei, Member of the Party Leadership Group and Vice President of the SIPC, and Su Guodong, Deputy Director of Shanghai Municipal Bureau of Ecology and Environment, signed the Memorandum of Cooperation between Shanghai Intellectual Property Court and Shanghai Municipal Bureau of Ecology and Environment on the Diversified Co-governance Mechanism of Environmental Resources (hereinafter referred to as the "MOC").

Since 2019, Shanghai Intellectual Property Court and four grass-roots courts, namely Chongming District People¡¯s Court, Jinshan District People¡¯s Court, Qingpu District People¡¯s Court and Shanghai Railway Transportation Court, have accepted 542 environmental resource cases in total, including 204 criminal cases, 27 administrative cases, 22 civil cases and 289 enforcement cases. The number of administrative cases on environmental resource is increasing gradually, and legal relationship involved in civil cases on environmental resource is complex and covers a wide range of fields. Faced with these problems, relevant judicial and administrative departments of environmental resources protection shall strengthen their work coordination and build a diversified co-governance mechanism.

This year is the final year for Shanghai's Three-year Action Plan for Environmental Protection and Construction (2018-2020). Eight measures were put forward in the MOC from the perspective of establishing working liaison mechanism, collaboration and coordination mechanism, communication and consultation mechanism, and joint publicity mechanism. At the same time, it is suggested to strengthen mutual cooperation to give full play to the professional advantage and front-end governance effectiveness of administrative environmental protection organs, improve the "three-in-one" trial mechanism, strengthen the prevention and control of eco-environment destruction, jointly promote the thorough implementation of eco-environment restoration, and resolve all kinds of environmental disputes with the help of administrative environmental protection organs and relevant professional institutions, so as to form a co-constructed, co-governed and shared protection pattern for eco-environment resources and thereby provide a strong guarantee for promoting the comprehensive protection of Shanghai's eco-environment resources and promoting its ecological civilization construction.

The conference was attended by relevant persons in charge of the trial of cases on environmental resource from Shanghai courts at all levels and heads of administrative eco-environment organs in each district.
