Brief Introduction to the Court |
Xuhui District People's Court of Shanghai is located in the famous business district in southwest Shanghai. The Court has 278 personnel and 57 assistant judicial clerks (as at November 2014). As Xuhui District People's Court is located in an area with thriving business and rich history and culture, the cases tried by the Court often involved celebrities, belonging to new types and major cases. In recent years, the number of cases accepted by the Court has increased year by year. In 2013, the Court accepted 25,739 cases in total, ranking top in the court system of Shanghai. |

Xuhui District People's Court has 16 departments, including the Case Filing Tribunal, Criminal Tribunal, Civil Tribunal I (common civil cases), Civil Tribunal II (business cases), Civil Tribunal III (intellectual property cases), Civil Tribunal IV (real estate cases), Civil Tribunal V (labor dispute cases), Administrative Tribunal, Enforcement Department, Trial Supervision Tribunal (sharing the same office with the Trial Management Office), Executive Office, Office of Political Affairs, Research Office, Discipline Inspection and Supervision Office, Bailiff Brigade and Litigation and Mediation Transition Center. |

Court Development |
Xuhui District People's Court of Shanghai gives full play to its role as a people's court, enforcing laws in a just way for the people and impartial justice to protect the healthy development of the regional economy and social harmony and stability. In 2002, the Court took the lead in introducing the new procedure named 'defensing of sentencing' in China, which granted the prosecutor the right of proposing the penalty and safeguarded the defendant's right of sentencing claim to further standardize sentencing, making the criminal justice more open, impartial and transparent. In the judgment of a theft case in May 2, 2011, the Court for the first time gave an injunction to the defendant that was under a suspended sentence. Besides, the Court added the procedure of suspended sentence hearing for the defendant to bring the roles of both the judicial authority and the social correction authority into better play. Since 2009, the Court, through continuous exploration and practice, has created a justice service platform with 'Qin Lingmei Tour Mediation Room', 'Litigation Service Center', 'Enforcement Service Center', and “Online Enforcement Service Center' to deal with judicial affairs in an impartial and efficient way. In addition, the Court continuously extended the judicial functions and magnified the effect of judgment by providing judicial advice and Judgment White Paper and other ways of suggesting that the airport code in standard language should be indicated on the airline ticket, standardizing the prior admission first-aid system of medical institutions, strengthening prevention of duty crimes and improving the anti-corruption mechanism to promote and participate in the social management innovation according to laws. |

Honors |
In recent years, Xuhui District People's Court of Shanghai strengthened team building and carried out cultural development actively to improve the capacity and quality of judicial personnel in dealing with judicial affairs by upholding its motto of 'worship wisdom and truth, respect virtue and law', and has cultivated a number of model individuals represented by Qin Lingmei, the National Excellent Judge, one of the 10 Outstanding Female Judges and the National March 8th Red-Banner Holder. The Court has been listed as Shanghai Model Unit for 12 consecutive years since 2001 and was awarded with the Third Class Merit Citation to Collectives in Shanghai court system in 2012. Besides, it was named as the 'people's court with outstanding achievements in the judicial publicity' by the Supreme People's Court in 2014. The Research Office won the 'Model in Organizing National Symposiums Award' by the Supreme People's Court in 2008. The Civil Tribunal II was named as the model collective in bankruptcy case trial by the Supreme People's Court in 2011. The Criminal Tribunal was listed as the 'National Model Collective of the Court System' by the Supreme People's Court and the 'National May 1st Women Model Post' by All-China Federation of Trade Unions in 2013. The Litigation and Mediation Transition Center was awarded with the First-Class Merit Citation to Collectives of Shanghai Court System in 2012 and was named as the 'National Model Court Collective' by the Supreme People's Court in 2013. |
