Overview

Shanghai Railway Transportation Intermediate Court was established on May 1, 1982. From July 1, 2012, according to the strategic deployment of the Central Government on the judicial system reform, the Court was integrated into the national unified judicial system from the original administration mode of a railway enterprise and included into the administration of Shanghai Municipality, the leadership of Shanghai CPC Committee and the supervision of the Shanghai Municipal People’s Congress and its Standing Committee. The trial court office building of the Court is located at No. 527 Wujin Road, Hongkou District. The Court has a total of 76 personnel and 89.47% of the registered permanent staff hold Bachelor's Degree or above, including 22 with Master's Degree, accounting for 28.94% of the total.

Brief Introduction to the Court

Shanghai Railway Transportation Intermediate Court was established on May 1, 1982. From July 1, 2012, according to the strategic deployment of the Central Government on the judicial system reform, the Court was integrated into the national unified judicial system from the original administration mode of a railway enterprise and included into the administration of Shanghai Municipality, the leadership of Shanghai CPC Committee and the supervision of the Shanghai Municipal People’s Congress and its Standing Committee. The trial court office building of the Court is located at No. 527 Wujin Road, Hongkou District. The Court has a total of 76 personnel and 89.47% of the registered permanent staff hold Bachelor's Degree or above, including 22 with Master's Degree, accounting for 28.94% of the total. According to the provisions of the Supreme People's Court on the jurisdiction of the railway courts, the second-instance trial of all railway-related cases accepted by the five railway transportation courts in Shanghai, Hangzhou, Nanjing, Hefei, and Xuzhou within the jurisdiction of Shanghai Railway Administration shall be conducted by Shanghai Railway Transportation Intermediate Court which supervises and guides the trial-related issues.

Organizational Structure

After the system restructuring, Shanghai Railway Transportation Intermediate Court has 12 departments, including the Case Filing Tribunal, Criminal Tribunal I, Criminal Tribunal II, Civil Tribunal, Trial Supervision Tribunal, Enforcement Department, Office of Political Affairs, Discipline Inspection and Supervision Office, Executive Office, Research Office, Trial Management Office, Bailiff Squad.

Court Development

In July 2012, the Supreme People's Court issued the judicial interpretation of the Several Provisions on the Jurisdiction of Railway Transportation Courts, which provided the jurisdiction of each railway transportation court after the restructuring. These Provisions defined types of criminal and civil cases shall be tried by the railway transportation courts as well as the procedures for designating the court of competent jurisdiction. According to these provisions, all decisions on designating courts of competent jurisdiction were then revoked and formalities and procedures on applying for approval shall be performed again. Upon the approval of the Supreme People's Court, Shanghai High People’s Court made formal reply on the cases to be tried by the railway courts at two levels and provided that Shanghai Railway Transportation Court shall, from September 26, 2013, accept the civil cases at first instance arising within the operation areas of Shanghai rail transit system, the first instance cases involving personal and property compensation arising from traffic accidents occurring within the jurisdiction of Shanghai Elevated Traffic Police Detachment, and the administrative cases at first instance arising within the operation area of Shanghai rail transit, and that Shanghai Railway Transportation Intermediate Court shall accept the cases on appeal for the judgments and decisions made on cases at first instance as described above. Upon the coordination among Shanghai High People’s Court, Shanghai People’s Procuratorate and Shanghai Municipal Public Security Bureau, the jurisdiction of criminal cases within the operation area of Shanghai rail transit system was adjusted, and from March 1, 2014, the criminal cases used to be handled by the Urban Rail Transit and Bus Corps under Shanghai Public Security Bureau shall be governed by the railway courts. According to the functions of the railway court defined after the restructuring, the railways courts at both levels in Shanghai will perform the judicial functions and will be better integrated into and serve for Shanghai.

Honors

It has been named as 'Shanghai Model Unit' from 2003. From 2010, it has awarded the Second Class Merit Citation to Collectives in Shanghai court system twice and the Second Class Merit Citation to Individuals once.
