On November 25, 2022, the Shanghai Xuhui District People¡¯s Court (the ¡°Shanghai Xuhui Court¡±) held a press conference to report the trial of commercial cases involving parties from abroad and from Hong Kong, Macao, and Taiwan in 2017-2022, and released a white paper and model cases. Mi Shifeng, member of the Party Leadership Group and vice president of the Shanghai Xuhui Court, gave a rundown of relevant situation.

The press conference was the ninth of a series of conferences on the Shanghai High People¡¯s Court¡¯s efforts to help create an international top-notch law-based business environment.

According to the press conference, from January 2017 to October 2022, the Shanghai Xuhui Court accepted 247 commercial cases of various types involving parties from abroad (144) and from Hong Kong (55), Macao (6), and Taiwan (42).

In the past six years, the number of such cases accepted by the Shanghai Xuhui Court has been on the rise. The cases, which cover areas such as cross-border trade, investment, and finance, are generally classified into four types: disputes over other contracts, disputes over civil loans, disputes over trading contracts, and disputes over equity transfers.

According to the white paper, the judicial needs of the parties involved in those cases have increased year by year, and the intertwined legal relationship, the emergence of electronic evidence, and other factors have made the cases more specialized and complex. At the same time, with the clearer market rules and the greater likelihood of solving the disputes through laws, an open and fair business environment based on the law is more likely to happen.

The five model cases released at the press conference cover the practical results achieved by the Shanghai Xuhui Court in recent years in its trial of commercial cases involving parties from abroad and from Hong Kong, Macao and Taiwan.
