


To promote the sound and orderly development of the cultural and tourism industry in Jinshan District, on April 23, 2025, the Jinshan District People's Court held a press conference to issue the Normative Guideline on Intellectual Property Standards for the Cultural and Tourism Industry in Jinshan District. Zhang Xinquan, Vice President of the Jinshan District People's Court, and Chu Hongmei, Chief Judge of the Civil Division (Environmental and Resource Cases Division), briefed the relevant situation. Attendees invited to the conference included representatives from the District Procuratorate, the Jinshan Public Security Sub-bureau, the District Culture and Tourism Bureau, the District Judicial Bureau, District Administration for Market Regulation, the Fengjing Town Government, the Management and Service Office of the LEGOLAND, deputies to the people's congress, representatives from cultural and tourism enterprises, and villagers' representatives.
At the meeting, Zhang Xinquan distributed the normative guideline to representatives of enterprises and villagers and briefed them on the characteristics of judicial protection for IP in the cultural and tourism industry, and common infringement risks in its development.
The Guideline released at the meeting, combined with 10 typical cases, closely aligned with the frequent IP infringement in the development of the cultural and tourism industry. It provides risk warnings and standard guidance regarding issues such as piracy of others' works, copyright infringement of cultural and tourism-related merchandise, counterfeiting of others' trademarks, sales of goods that infringe upon the exclusive rights of registered trademarks, use of trademarks beyond the "indicative scope," imitation of others' decorations and furnishings, and use of others' trademarks for corporate names. This strengthened judicial protection for the cultural and tourism industry, regulated business practices in the cultural and tourism market, enhanced consumers' sense of security, and safeguarded the high-quality development of the cultural and tourism industry.
A representative of LEGO Toy (Shanghai) Co., Ltd. indicated that, as the LEGOLAND Shanghai Resort is currently preparing to open, the release of this guideline has not only enhanced the compliance awareness of the general public and relevant practitioners but also provided significant support for the LEGO Group's subsequent IP protection efforts. In the future, the LEGO Group will continue to actively cooperate with relevant departments to promote IP compliance training and legal education, contributing to the establishment of a sound and well-ordered ecological environment for the cultural and tourism market.
