In order to thoroughly implement the strategic requirement of the Shanghai Municipal Committee to "make Fengxian a key growth pole in Southern Shanghai", and in line with the Fengxian District Committee’s work requirement to "continuously enhance the source-generating capacity of scientific and technological innovation and the leading role of high-end industries, accelerate the integrated development of industry and city as well as urban and rural areas, and continuously open up new prospects for the practice of Chinese-style modernization in Fengxian", and give full play to its role of judicial functions and provide strong judicial services and safeguard the construction of Shanghai's "Five Centers", Fengxian District People’s Court in Shanghai (hereinafter referred to as Fengxian District People’s Court) has formulated the Eight Measures by Fengxian District People's Court in Shanghai for Judicial Services to Safeguard the Important Growth Pole of Southern Shanghai (hereinafter referred to as the Eight Measures), based on the Opinions of the CPC Fengxian District Committee of Shanghai on Striving to Build a Key Growth Pole in Southern Shanghai and in light of its practical work.
On the afternoon of July 31, the Fengxian District People's Court held a press conference. Chen Jiayu, Member of the Party Leadership Group and Vice President of the Fengxian District People's Court, reported on the Eight Measures for judicial services to build a key growth pole in Southern Shanghai. Hu Jingjing, Head of the Trial Supervision Division (Trial Management Office and Research Office), introduced relevant typical cases. Deputies to the Fengxian District People's Congress, members of the Chinese People's Political Consultative Conference (CPPCC), and some media representatives were invited to attend the press conference. The press conference was presided over by Xia Jidong, Member of the Party Leadership Group and Vice President of the Fengxian District People's Court.
Release of Support Measures and Typical Cases
The Eight Measures closely align with the overall regional development agenda, formulating initiatives across eight key areas: judicial support for scientific and technological innovation, assistance in the industrial ecosystem optimization, creation of a top-tier business environment, strengthening the trial of foreign-related commercial cases and livelihood-related cases, deepening the protection of workers' rights, promoting judicial outreach to advance rural revitalization, and striving to build a high-quality court team. These initiatives aim to provide solid judicial services for "making every effort to build a key growth pole in Southern Shanghai".
The typical cases released on this occasion cover areas such as intellectual property, land leasing in industrial parks, enforcement in support of the real economy, and labor disputes in emerging industries. By reviewing and analyzing relevant typical cases concluded by Fengxian District People's Court in recent years, valuable references and guidance are provided for the judicial service to "strive to build a key growth pole in Southern Shanghai", thereby contributing to the high-quality development of the regional economy.
For example, in a dispute over infringement of trade secrets, a former senior executive of a company exploited the trade secrets acquired during his tenure to seize a large number of orders, causing losses to the rights holder. To quickly resolve the dispute, the Fengxian District People's Court adopted the model of administrative mediation with judicial confirmation, facilitating a settlement between the parties. While the parties signed an administrative mediation agreement, they also applied for judicial confirmation. By leveraging judicial enforcement power, the court ensured the effective performance of the mediation agreement, thus achieving a win-win outcome of protecting trade secrets and stabilizing market order.
Trade secrets are crucial intellectual property assets for enterprises and represent their core competitive strength. Fengxian District People's Court is committed to leveraging the advantages in rapid rights protection and judicial enforcement. By integrating administrative-judicial collaboration and proactive intervention in dispute resolution, it compels infringers to immediately rectify their conduct and make efficient compensation, thereby achieving the organic unity of political, legal, and social effects.
For example, in a labor dispute case, a biological products company ceased production due to operational difficulties, which triggered wage arrears disputes involving 151 employees. The Fengxian District People's Court, together with the District Federation of Trade Unions, activated the joint enforcement mechanism for the protection of workers' rights. Through the "green channel" for expedited filing and enforcement of livelihood-related cases, the court investigated and controlled the company's assets and facilitated a settlement, successfully concluding all cases properly.
The joint enforcement mechanism for the protection of workers' rights is an innovation actively promoted by the Fengxian District People’s Court in applying diversified dispute resolution mechanisms in the enforcement field. Through "pre-enforcement consultation + pre-enforcement urging + multi-parties coordination", it prioritizes the rapid registration, enforcement, and conclusion of wage arrears cases, effectively addressing the "urgent needs and pressing concerns" for the public.
