Jiading District People¡¯s Court Inaugurated the ¡°Sixiangjia Lecture Hall,¡± with the Opening of the First Lecture on Digital Economy Judicial Practice Research

 Recently, the opening of the first lecture on Digital Economy Judicial Practice Research and the inauguration of ¡°Sixiangjia Lecture Hall¡± were held in Shanghai University of Political Science and Law, to learn and implement thoroughly the spirit of the important instructions from general secretary Xi Jinping on the rule of law and legal talent cultivation, to carry out the Opinions on Strengthening Legal Education and Legal Theoretical Research in the New Era from the General Office of the CPC Central Committee and the General Office of the State Council and the Opinions on Strengthening Legal Theoretical Research of People¡¯s Court in the New Era from the Supreme People¡¯s Court, to implement earnestly the Implementation Plan for Shanghai Courts on Comprehensively Deepening Intercollegiate Cooperation in Bearing Joint Responsibilities for Legal Talent Cultivation in the New Era, and to promote high-quality justice with high-quality researches.

Gu Quan, secretary of the Party Leadership Group and president of Jiading District People¡¯s Court of Shanghai (hereinafter referred to as the ¡°Jiading District People¡¯s Court¡±), and Zheng Shaohua, vice president of Shanghai University of Political Science and Law attended the activity and addressed a speech. Yang Yingfei, member of the Party Leadership Group and Director of the Political Department of Jiading District People¡¯s Court, relevant persons in charge of the School of International Law, the Office of Postgraduate Affairs, and Shanghai Judicial Research Institute of Shanghai University of Political Science and Law, trial talents of Shanghai Court Digital Economy Judicial Research and Practice (Jiading) Base (hereinafter referred to as ¡°the Base¡±), and lecture representatives of Digital Economy Judicial Practice Research, joined the activity. Shi Jianping, deputy dean of the School of International Law of Shanghai University of Political Science and Law, presided over the activity.

During the activity, Zheng Shaohua and Gu Quan inaugurated the ¡°Sixiangjia Lecture Hall¡± together.

¡°Sixiangjia Lecture Hall¡± serves as a new brand for Jiading District People¡¯s Court to engage with universities and a new medium for the continuous promotion of the organic integration of ¡°education+ theory+ justice.¡± The positive interaction between theoretical and practical innovation is realized by establishing characteristic quality courses including Digital Economy Judicial Practice, etc. for colleges and universities, focusing on difficulties in judicial practices and hot issues reflected by social phenomena, combining legal education with judicial practice, and continuously enabling effective implementation of key measures in optimizing curriculum provision, allocation of teachers, compilation of textbooks, as well as internship and practical training, while achieving deep integration.

The Digital Economy Judicial Practice Research course, initially introduced by ¡°Sixiangjia Lecture Hall,¡± represents the first digital economy judicial practical course provided by universities across the country. It depends on the ¡°theory+ industry+ justice¡± think tank consortium of Shanghai Court Digital Economy Judicial Research and Practice (Jiading) Base, which is joined by the judicial professionals of Jiading District People¡¯s Court in the digital economy field as well as the practical experts from first-class Internet platform enterprises and eco-enterprises involved in the Internet transformation.

 The course is provided in accordance with the classification research system of digital economy cases of the Base. It encompasses four directions including the first type ¡°dispute involving protection of personal information and associated personality rights and interests,¡± the second type ¡°dispute involving property rights and interests in data form and market competition order,¡± the third type ¡°dispute involving legal obligations of platform operators and protection of rights and interests of related entities,¡± and the fourth type ¡°criminal cases involving prevention and control of information network offense and online grey and dark industry chains.¡± These types span multiple key areas of criminal, civil, and commercial fields, covering multiple dimensions including practical experience sharing, judgment reasoning and reading, and hands-on practicing experience, etc. The course is taught based on the three batches of typical cases announced by the Base to put effort into building a ¡°one-stop¡± vivid classroom scene that integrates trial, research, and academia.

During the activity, Wei Lei, the deputy director of the Office of Postgraduate Affairs of Shanghai University of Political Science and Law, and Xu Guojian, distinguished dean of the School of International Law of Shanghai University of Political Science and Law awarded letters of appointment to the lecturing judges present.

The Jiading District People¡¯s Court is about to compile dedicated textbooks for the thematic courses, such as Cutting-Edge Problems and Judicial Practice Research on Digital Economy, and Classification Research and Judicial Demonstration on Cases Involving Digital Economy, etc., in order to promote the transformation of ¡°digital¡± thinking paradigm among law students, cultivate a ¡°thorough¡± research perspective and encourage a systematic thinking pattern, and focus on the practicality and effectiveness of legal talent cultivation.

With a firm grasp on the classification research system of digital economy and a focus on the theme of Classification Research on Problems on the Application of Law to Disputes involving Digital Economy, Gu Quan presented the first lecture of Digital Economy Judicial Practice Research course to more than 200 graduate and undergraduate students around the university from seven aspects including ¡°object characteristics and screening of nature of rights.¡± Some district deputies to the National People¡¯s Congress sat in.

Chen Lingyu, a graduate student of the School of International Law of Shanghai University of Political Science and Law, expressed her honor to listen to the course of Classification Research on Problems on the Application of law to Disputes involving Digital Economy. As a student majoring in data law research, she emphasized that disputes involving digital economy have become increasingly diversified and complicated nowadays. Though meticulous analysis and exposition by the judge, new perception was formed regarding the application of theories on data law to practices, such as the method of applying the law when private information and sensitive personal information coincide, and the differentiation and analysis of academic perspectives on the compulsory licensing system in the application of law, etc.

Shi Jianping, deputy dean and associate professor of the School of International Law of Shanghai University of Political Science and Law, expressed, ¡°data is not everything, but everything is becoming data.¡± Contemporary college students are increasingly exposed to digital and platform economy. As a result, the topic of how to interpret dispute in the digital economy from the perspective of judicial trials is undoubtedly and tremendously appealing to law school students. Based on the years of experience in judicial trial and research, the lecturer organized and elucidated the types of disputes in the digital economy and the application of law, and summarized and covered the latest typical cases during the explanation from the dissection of relevant concepts to the analysis of applicable legal provisions. Throughout the presentation, the lecturer provided comprehensive and insightful explanations, which greatly inspired the interest and passion of law school students for further thinking and research on the cutting-edge theories of the rule of law in the digital era and difficult issues in judicial practice.

Feng Yan, deputy to the Jiading district People¡¯s Congress, practical expert of the Base, Senior Vice President of Trip.com Group, and CEO of Ctrip Finance, expressed, Jiading District People¡¯s Court, closely following the workforce development strategy, conscientiously shoulders the responsibility of legal talent cultivation; leveraging the advantages of being the first base nationwide, it has launched the characteristic brand of ¡°Sixiangjia Lecture Hall¡± and cooperated with Shanghai University of Political Science and Law to establish a digital economy judicial practical course system, which further expands the scope of integration and joint cultivation, positively explores multi-type and all-round forms of cooperation. It has established a long-acting green channel of ¡°Double-Door¡± between schools and courts, effectively promoting the experience and outcomes of advancing judicial practical courses into universities ¡°from points to areas.¡±

Based on the medium of the first Digital Economy Judicial Practice Research course across the country, ¡°Sixiangjia Lecture Hall¡± has continuously integrated research with education and learning with research from the perspectives of professional system, teaching system, textbook system, and assessment system, etc., and established a high-quality legal talent cultivation system with the characteristics of regional universities, which forcibly enhances the communication and integration of legal theories and judicial practices within the people¡¯s court in the new area and sets new examples for the establishment of new brands and think tanks through intercollegiate cooperation with the characteristics in the digital era.

In the future, Jiading District People¡¯s Court will keep digging deep into the resource advantages of being the first base nationwide, and adhere to the philosophy of prioritizing scientific education and practical experience, enhancing characteristic judicial practical quality courses, and establishing cultural brands through intercollegiate cooperation. The court looks forward to the experience and outcomes of joint cultivation of legal talents based on intelligence sharing, resource integration, and mutual complementation of advantages.
