To
thoroughly implement the national strategy of building a cyber power and a
digital China, facilitate the digital transformation of Shanghai city, deeply
integrate law and technology, and provide services and safeguards for the
development of the digital economy and new quality productive forces, on the
morning of September 29, the Shanghai Jiading District People's Court
(hereinafter referred to as the Jiading District People's Court) held a press
conference to release the sixth batch of typical cases from Shanghai Court
Digital Economy Judicial Research and Practice (Jiading) Base.
Zhang
Guodong, a member of the Party Leadership Group and Vice President of the
Jiading District People's Court, reported on the operational status of the base
in 2025, released ten typical cases involving the digital economy, and answered
questions from reporters. Deputies to the Shanghai Municipal People's Congress
and some news media were invited to attend the press conference. The press
conference was presided over by Yang Yingfei, a member of the Party Leadership
Group, the Director of the Political Department, and the spokesperson of the
Jiading District People's Court.
Since
its inception, Shanghai Court Digital Economy Judicial Research and Practice
(Jiading) Base has consistently adhered to the development philosophy of
"Rooted in real cases, upholding integrity and fostering innovation,
prioritizing people, and embracing the boundless potential of digital
intelligence." It has pioneered the establishment of a four-category case
classification research system, forged a "theory + industry +
judiciary" think tank consortium, improved the mechanism for consultation
and mutual recognition of adjudication rules, extended the incubation of the
new-quality strategy of "joint demonstration and publication of rule
guidelines and typical cases in the digital economy." These efforts have
propelled the coordinated development of academic research, judicial practice,
and the market rule ecosystem within the digital economy, gradually fostering a
demonstration effect of the innovative brand "Jiading Digital Wisdom &
Innovation" and showcasing the positive outcomes of judicial safeguarding
for the growth of the digital economy.
The
sixth batch of typical cases released this time mainly consist of effective
cases from the courts in the past three years, covering cases recommended by
strategic cooperation units of the base such as the courts in Kunshan and
Taicang, Jiangsu Province. These cases have undergone special discussions by
nearly a hundred experts at the "Digital Intelligence Liucheng Cup"
Essay Award Ceremony and the "Digital Economy and Digital Rule of
Law" Exchange Meeting of the Digital Economy Base. They cover various
fields such as criminal, civil, commercial, and intellectual property cases,
and are sorted according to the four major case classification research
systems. They focus on cutting-edge issues such as "data rights and
interests of intelligent assisted driving vehicles" and "the shutdown
and merger of online game servers," delineating behavioral boundaries and
stabilizing development expectations for digital economy entities, providing
referable adjudication guidelines for the trial of similar cases, and
demonstrating the vivid practice and pioneering exploration in judicial
safeguarding for the development of the digital economy.

the Jiading District Committee of the Revolutionary Committee of the Chinese
Kuomintang
Since
its establishment, Shanghai Court Digital Economy Judicial Research and
Practice (Jiading) Base has always focused on serving the high-quality
development of the digital economy, constructing a virtuous cycle of
"research guiding practice and practice feeding back into
governance," based on case classification research, with the incubation of
typical cases as a focal point and professional talent cultivation as support.
The typical cases released this time are both cutting-edge and representative. Whether
it is judicial protection of newly emerging property rights and interests
involving data forms or assistance in the standardized governance of the online
gaming and internet logistics industries, they precisely meet the practical
needs of the development of the digital industry, achieving a deep integration
of judicial judgments and data governance, providing solid judicial guarantees
for the development of the digital economy and new-quality productive forces,
and further promoting the uniform application of law in the Yangtze River Delta
region.
Xu
Xiaofang, Deputy to the Shanghai Municipal People's Congress, Secretary of the
General Party Branch and President of the Jiading District Institute of
Education
My
first impression of the typical cases released this time is: novelty. The cases
involve cutting-edge fields such as data from intelligent driving assistance
system vehicles and payment codes for virtual products. By exploring and
establishing new rules, they define the boundaries of corporate innovation and
the norms of platform autonomy, creating a stable, fair, and predictable legal
environment for the digital economy. Issues such as the shutdown and merger of
online game servers, passengers' fare evasion in ride-hailing cruising taxis,
and mobile phone numbers and verification codes intercepted by "pseudo
base stations" occur in everyone's daily life scenarios. The typical cases
transform abstract legal provisions into vivid judgments, effectively resolving
the "new troubles" encountered by people in the digital age, and
giving the public a greater sense of gain, happiness, and security.
