Jia Yu Investigated Yangpu: Promote Local Development Through Intelligent Judicial Governance for Shared Benefits

On the morning of July 24, Jia Yu, secretary of the Party Leadership Group and president of the Shanghai High People’s Court, came to Yangpu District for an investigation. With the new data, new problems, and new situations mentioned at the symposium of the city’s court presidents last week, Mr. Jia wanted to know more about the revitalization of this old industrial city district, with a focus on examining how the Yangpu District People’s Court (“Yangpu Court”) has changed its mindset, focused on the key aspects, and implemented the policies and measures.

  Starting from the site of the Huangpu River Pier and marching along the relief wall in memory of revolutionaries’ work-study experiences in France, Mr. Jia watched the scene engraved on the wall of the Chinese progressive youth travelling across the oceans.

  They came to Yangpu Riverside, where they saw the cabin-shaped Qinhuangdao Pier Party-Mass Service Station, which is the first party-mass service station built in Yangpu Riverside. Mr. Jia walked into the service station and got a public legal service map at the entrance. He opened the map and asked for more information about it. “It is also a way for the people’s court to provide legal services by offering judicial advice to help promote corporate and social development through the big data,” he said.

  Leaving the service station, they walked along the river. The steel and wood structured trestle made one feel as if they were walking on the deck. From the “industrial rust belt” to the “desirable living area”, the District sees a combination of the century-old history and the future of the people’s city.

  Xue Kan, secretary of the CPC Yangpu District Committee, told Mr. Jia about the District’s planning and exploration in practicing the concept of “people’s city”. In the people’s city planning exhibition hall, Mr. Jia walked through the interactive, touch-controlled electronic bookshelves, learning about the theoretical origin and development context of this concept. When talking about the practice of intellectual property protection in Yangpu in building a beautiful city, he stressed that the judiciary should pay attention to the problems brought by the obstacles to and the rapidity of development. “We should notice the obstacles to development and deal with the disputes over intellectual property; meanwhile, in light of rapidity of development, we should explore compliance reform in enterprises. As a number of leading digital enterprises have settled in Yangpu, the Yangpu Court should take a step forward to improve the trial efficiency of intellectual property cases and create a paradigm of litigation source governance in key industries and key areas,” said Mr. Jia.

  At the general command center of Meituan at Blink, Mr. Jia learned about how the enterprise had used digital means to ensure a better life in the city and enable the operation and management of the city. He was also introduced to Xiaomei Jury, an online dispute resolution mechanism.

  “Can all customers be on the jury?” “Has it ever happened that a jury member leaves sharp comments online that aggravate the disputes?” “Do your counterparts have similar dispute resolution mechanisms?” Mr. Jia asked about the effectiveness of this new mechanism. “This is the enterprises’ independent and innovative attempt to resolve disputes, and it is also a positive example of the court’s support for litigation source governance. That the enterprises mobilizing users to jointly resolve disputes is a good practice of involving the masses into the litigation source governance,” he said.

  At the symposium held later at the Yangpu Court, Mr. Jia once again talked about the example of Meituan, stressing the importance of comprehensive management in the litigation source governance. “Litigation source governance requires the leadership of the Party Committee, a responsible government, coordinated efforts across society, the engagement of the public, and the rule of law. Good social governance shall guarantee good governance of litigation source,” he said.

  At the symposium, Mr. Jia listened to Hu Yu’ang, Standing Committee member and secretary of the Political and Legal Affairs Committee of the CPC Yangpu District Committee, talking about the District’s transformation and rule of law, the Party Leadership Group of the Yangpu Court reporting the Court’s current work, and the representatives of the officers and police staff offering their opinions and suggestions. For the Court’s work in the next stage, Mr. Jia mentioned the three points below:

  First, the Court should resume its responsibility with high Party consciousness.Judicial trial must guarantee what is needed in the development of the Party,” said Mr. Jia. This year the Yangpu Court has issued a number of opinions on providing judicial service and guarantee; and the point is it should take specific and feasible measures to implement those opinions.

  Second, the Court should evaluate its work based on its trial performance. It should improve the quality and efficiency of trial. With the new system of trial quality management indicators issued by the Supreme People’s Court, the Court can offer its suggestions based on its actual situation, as long as they can help improve the quality and efficiency of case handling. More efforts should be made to build a digital court. The Court should start with the changes in small aspects, and the successful application of scenarios relies on the primary courts and front-line judges. It should attach great importance to and launch the program extensively, carry out scenario modeling, and introduce more useful scenario applications.

  Third, the Court should ensure full and strict governance and build a strong team. It should continue to improve its capabilities, and use Yangpu’s advantage to work with the prestigious universities there on the cultivation of legal talent. It should also pay close attention to the Party conduct and clean government, with greater efforts being made to implement the “Three Regulations”, which should be valued as the “firewall” of ensuring the Party conduct and clean government.
