Shanghai Third Intermediate People's Court Releases the Implementation Opinions on Enhancing

On December 27, 2024, the Shanghai Third Intermediate People's Court (Shanghai Intellectual Property Court and Shanghai Railway Transportation Intermediate Court) held a press conference to issue the Implementation Opinions of the Shanghai Third Intermediate People's Court (Shanghai Intellectual Property Court and Shanghai Railway Transportation Intermediate Court) on Enhancing "Four Functions" and Creating "Four Paradigms" (2025-2027) (hereinafter referred to as the "Implementation Opinions"). Xi Jianlin, Secretary of the Party Leadership Group and President of the Court attended the event. Qian Guangwen, President of the Intellectual Property Comprehensive Trial Second Division and Senior Judge of the Second Rank, Yue Qimu, President of the Civil Division (Environment and Resource Division, Enforcement Disputes Division); Xu Ziliang, President of the Bankruptcy Division and Shanghai Bankruptcy Court; and Ding Xiaohua, President of the Administrative Division (Compensation Committee Office, Tax Affairs Tribunal), participated. Wu Yingzhe, President of the Appeals Review and Judicial Supervision Tribunal (Research Office, Judicial Administration Office), chaired the press conference.

The Implementation Opinions first addresses the objective of "Enhancing the Function of Serving Scientific and Technological Innovation, Cultivating a Preferred Venue for Intellectual Property Adjudication". It also outlines a series of measures on the effective management of intellectual property trials from 2025 to 2027, clearly reflecting the court's clear stance on supporting and protecting the entities involved in scientific and technological innovation, and its commitment to serving the innovation through judicial efforts. The issuance of the Implementation Opinions will undoubtedly enhance the leading role of judicial protection of intellectual property rights, improve the effectiveness of protecting innovation results, stimulate the innovative potential of entities engaged in scientific and technological innovation, and promote the research and development and transformation of core technologies. This will provide a better environment for entities involved in scientific and technological innovation.

In terms of scope, the Implementation Opinions reflects a commitment to "comprehensiveness", leveraging the judicial functions of the people's courts to enhance the professionalism and judicial credibility in intellectual property, bankruptcy, administrative, and environmental resource adjudication. In terms of measures, the Implementation Opinions is "practical". It address current challenges in adjudication with targeted measures. The release of the Implementation Opinions is expected to actively promote the courts in achieving new results in serving the overall situation and serving the public.
